Three for Three at Navy Discharge Review Board

Mr. Cassara recently had three cases before the Navy Discharge Review Board in one day, and succeeded in getting all of their discharges upgraded from Other Than Honorable (OTH) to General (Under Honorable Conditions.) While the cases are all different, they provide a good insight into what we can do in certain cases.

In the first case, Mr. Cassara represented a former sailor who had 14 years of service when he received an OTH discharge for fraudulent receipt of housing allowances. He spent his time after the Navy going to school and staying employed. Based solely on his post service accomplishments, we were able to get his discharge upgraded.

In the second case, Mr. Cassara represented a former Marine who was discharged for illegal use of drugs. Mr. Cassara was able to provide sufficient mitigating evidence to have his discharge upgraded.

In the last case, Mr. Cassara represented a former sailor who received an OTH for an assault on a fellow shipmate. Mr. Cassara presented eye witness testimony and other information to demonstrate that the sailor was not the aggressor in the altercation, and the sailor's discharge was upgraded.

All of these cases required in depth analysis and a case work up to show the NDRB why the service member deserved to have their discharge upgraded.
