Sailor's discharge enables him to retain all benefits

Mr. Cassara represented a Navy E-6 who was being administratively discharged for allegations of serious misconduct at Fort Gordon, GA. The command was pushing for him to receive an Other Than Honorable (OTH) Discharge. After a fully litigated Board hearing, the sailor was discharged under Honorable Conditions, allowing him to keep all of his benefits. As the sailor did not deny the allegations of misconduct, the only question was the characterization of discharge.
